EPA/WATER RIN: 2040-AD02 Publication ID: Spring 2016
Title: NPDES Permit Requirements for Municipal Sanitary Systems, Municipal Satellite Collection Systems, Sanitary Sewer Overflows, and Peak Excess Flow Treatment Facilities
Abstract: Instead of promulgating a new regulation at this time, EPA is going to continue to use existing regulatory authorities to implement the following practices to address sanitary sewer overflows (SSOs) and municipal separate sewer collection systems. Since 1998, EPA has been addressing communities with SSOs under the National Enforcement Initiative (NEI). More recently, EPA clarified reporting requirements for SSOs under 40 CFR 122.41(l)(6) and (7) as part of the 2015 NPDES electronic reporting rule. In recent years, EPA has issued a number of NPDES permits that include municipal satellite sewer collection systems conveying wastewater to the plant as co-permittees (see In re: Charles River Pollution Control District, NPDES Appeal No. 14-01, February 4, 2015.) These permits establish SSO reporting and collection system operation and maintenance requirements for the municipal satellite co-permittees.
