| Title: Water Quality Standards for the State of Florida's Streams and Downstream Protection of Lakes: Remanded Provisions | |
| Abstract: Consistent with a February 18, 2012 court ruling, which remanded to the EPA two portions of its numeric water quality standards for nutrients in Florida that were promulgated and published on December 6, 2010. On November 30, 2012, EPA signed proposed criteria for Florida's streams not otherwise covered by EPA-approved state numeric nutrient criteria, as well as approaches for developing downstream protection values (77 FR 74985). On November 30, 2012, June 27, 2013, and September 26, 2013, EPA approved numeric nutrient standards adopted by the state of Florida for certain waters in the state. Finally, a January 7, 2014 ruling by the U.S. District Court for the Northern District of Florida granting EPA's motion to modify the consent decree allows EPA to withdraw the overlapping federally-promulgated criteria so Florida can implement their state-adopted, EPA-approved criteria to address nutrient pollution in Florida's waters. As a result, EPA no longer intends to finalize this November 30, 2012 rule. | |
