The Environmental Protection Agency (EPA) published the final Lead and Copper Rule Revision (LCRR) on January 15, 2021. The EPA subsequently reviewed the LCRR and decided to initiate a new rulemaking process to improve the rule. This new National Primary Drinking Water Regulation is called the Lead and Copper Rule Improvements (LCRI). The LCRI is the culmination of numerous consultations and engagements with stakeholders and the public during the LCRR review and development of the proposed rule. During the review of the LCRR, the EPA held a series of engagements from April to August of 2021 to obtain public input. The EPA developed the LCRI to strengthen the regulatory framework and address lead in drinking water. To support the development of the LCRI, the EPA held numerous consultations and engagements including the EPA initiated the Regulatory Flexibility Act/Small Business Regulatory Enforcement Fairness Act consultations in May 2022 and concluded in July 2023; EPA initiated consultation with the Science Advisory Board in September 2022 and concluded in December 2022. The EPA held its first State co-regulator meeting on October 5, 2022 and held its second meeting on November 2, 2022; the EPA held an Unfunded Mandates Reform Act/Federalism consultation meeting on October 13, 2022; the EPA held two environmental justice consultation meetings pursuant to Executive Order 12898 on October 25, 2022 and November 1, 2022; the EPA held its first tribal consultation meeting on October 27, 2022 and held its second meeting on November 9, 2022; the EPA conducted its consultation with the National Drinking Water Advisory Committee on November 30, 2022. On November 30, 2023, EPA announced the proposed LCRI, and the Federal Register Notice was published on December 6, 2023. The public comment period concluded on February 5, 2024. EPA received almost 200,000 comments. EPA held a virtual public hearing on January 16, 2024, where the public was invited to provide EPA with verbal comments. EPA conducted its consultation with the National Drinking Water Advisory Committee on the proposed LCRI on January 31, 2024.
