Title: Imports and Exports of Hazardous Waste: Implementation of the OECD Decision for Recyclable Wastes 
Abstract: On March 30, 1992, the Organization for Economic Cooperation and Development (OECD) adopted the Council's Final Decision on the Control of Transfrontier Movements of Wastes Destined for Recovery Operations. The United States, a member of the OECD, supported the Decision, which is legally binding. The Decision established a graduated system of procedural controls for the export and import of wastes for recovery, depending on whether a waste is included in the green, amber, or red lists. Green wastes are subject only to controls imposed in normal international commercial shipments. Amber and red wastes that are considered hazardous are subject to additional controls regarding: notification to and consent from the exporting, importing, and transit countries; contracts; tracking documents; and recordkeeping. The Agency is codifying these provisions in an interim final rule which would replace the current RCRA export/import regulations for hazardous waste destined for recovery within the OECD. These changes do not affect the RCRA export/import regulations for hazardous wastes moving to or from Canada and Mexico for treatment or disposal within the OECD or moving for treatment, disposal or recovery purposes to other countries outside the OECD.
