Title: Vacatur Response--CERCLA/EPCRA Administrative Reporting Exemption for Air Releases of Hazardous Substances From Animal Waste at Farms; FARM Act Amendments to CERCLA Release Notification Requirements 
Abstract:

On December 18, 2008, the EPA published a final rule, "CERCLA/EPCRA Administrative Reporting Exemption for Air Releases of Hazardous Substances from Animal Waste at Farms" (73 FR 76948) (the 2008 Final Rule). The 2008 Final Rule established exemptions from certain reporting requirements under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and the Emergency Planning and Community Right to Know Act (EPCRA). On April 11, 2017, the U.S. Court of Appeals for the District of Columbia Circuit vacated the 2008 Final Rule with a mandate issued on May 2, 2018. The EPA is issuing a final rule to implement the court's vacatur of the 2008 Final Rule. This rule also incorporates CERCLA revisions enacted by the Fair Agricultural Reporting Method (FARM) Act, signed into law on March 23, 2018, which exempts reporting of air emissions from animal waste under CERCLA.
