Abstract:

The EPA is seeking to extend compliance timeframes for certain inactive surface impoundments subject to regulations governing the disposal of coal combustion residuals (CCR) as solid waste under subtitle D of the Resource Conservation and Recovery Act (RCRA). These revisions are being taken in response to a partial vacatur of the rule, which was ordered by the United States Court of Appeals for the District of Columbia Circuit (D.C. Circuit) on June 14, 2016.
