| Title: ●Portland Cement Manufacturing NESHAP and NSPS--Proposed Amendments as a Result of Reconsideration | |
| Abstract: On September 9, 2010 EPA promulgated final amendments to the Portland cement National Emission Standard for Hazardous Air Pollutants (NESHAP) and New Source Performance Standard (NSPS) rules regulating emissions of air toxics and criteria pollutants. These amendments applied to all cement kilns that do not burn waste materials. (Cement kilns that burn waste are regulated by separate rules covering hazardous waste combustors and commercial and industrial solid waste incinerators). Subsequent to promulgation of the September 9 rule, we received four petitions for reconsideration, two from environmental groups and two from the Portland cement industry. In this action, we will first issue a notice stating whether we plan to grant or deny the petitions. If our response includes any rule amendments, we will subsequently propose and finalize those amendments. The action may also include any corrections and clarifications discovered to be necessary after promulgation of the September 2010 amendments. We do not anticipate any significant changes in rule stringency as part of this action. We also received 20 petitions for judicial review of the September 9, 2010 final action. We anticipate that these petitions will continue to go forward even as we reconsider some parts of the rule. We are assuming that legal action on portions of the rule that are being reconsidered will be held in abeyance until the reconsideration is complete. | |
