| Title: ●Extension of Deadline for Action on Supplemental Section 126 Petition From New Jersey | |
| Abstract: This rulemaking was a procedural action that extended the deadline for EPA to act on the supplemental petition submitted from New Jersey Department of Environmental Protection (NJDEP). On May 13, 2010, we received a petition from NJDEP, filed under section 126 of the Clean Air Act (CAA). The petition requested that EPA make a finding that the coal-fired Portland Generating Station (Portland Plant) in Upper Bethel Township, Northampton County, Pennsylvania, is emitting air pollutants in violation of the provision of section 110(a)(2)(D)(i) of the CAA with respect to both the 24-hour PM2.5 National Ambient Air Quality Standards (NAAQS) and the 3-hour and 24-hour sulfur dioxide (SO2) NAAQS. Section 126 requires the EPA to take final action to grant or deny the petition within 60 days of receipt. However, a separate provision of the CAA allows EPA to extend the statutory deadline for action by up to 6 months if the Agency determines that additional time is needed for the rulemaking process. EPA filed a 6-month extension to act on the petition on July 12, 2010. This extended the deadline to act to January 12, 2011. On September 17, 2010, NJDEP submitted a supplemental information petition to the original petition received in May. The supplemental petition requests that EPA make a finding that the Portland Plant is also emitting air pollutants in violation of the provision of section 110(a)(2)(D)(i) of the CAA with respect to the new 1-hour SO2 NAAQS. | |
