Abstract:
This final rule under the good cause exemption of the Administrative Procedures Act would issue a finding of failure to submit (FFS) for all states that have failed to submit infrastructure state implementation plans (SIPs), for the 2010 NO2 NAAQS which were due on January 22, 2013. The FFS would start an 18 month sanctions clock, which can be turned off by a finding that a complete SIP was submitted. Plus, the FFS would start a 2 year Federal Implementation Plan clock, which can be turned off by approval of the SIP. |
