Title: ●Extension of Deadline for Action on the July 2016 Section 126 Petition From State of Delaware 
Abstract: This final action extends the deadline to respond to a petition to the EPA under section 126 of the Clean Air Act (CAA) by 6 months. In July 2016, State of Delaware submitted a petition to the EPA under section 126 of the CAA. The state requests that the EPA making a finding that emissions from the Brunner Island Generation Station located in York, Pennsylvania are significantly contributing to the nonattainment of, and interfering with maintenance of, the 2008 8-hour ozone NAAQS in Delaware. In this procedural action, the EPA is extending by 6 months the deadline for taking action on the petition. Section 126 requires the EPA to grant or deny a petition within 60 days. The petition was received on July 7, 2016, and provides us with a September 5, 2016 deadline. However, the CAA authorizes the EPA to grant a time extension of up to 6 months for responding to a petition if the extension is necessary, among other things, to meet the purposes of the CAA's rulemaking requirements. The EPA is determining that the 60-day time period is not sufficient for us to develop an adequate rulemaking responsive to the petition.
