This final action implements emission guideline requirements for existing municipal solid waste (MSW) landfills located in states and Indian country where state plans or tribal plans are not currently in effect, either because the state or local agency failed to submit a plan or because a plan has not yet been approved. Therefore, consistent with Clean Air Act (CAA) section 111(d)(2), this rulemaking imposes a federal plan that applies to MSW landfills in any state, tribe, or locale that has not submitted a satisfactory plan. This action makes no changes to the emission standards or compliance times specified in the "Emission Guidelines and Compliance Times for MSW Landfills" rule (40 CFR part 60, subpart Cf) and is intended to fulfill the EPA's duty under CAA section 111(d)(2) to promulgate a federal plan as a gap-filling measure until the state fulfills its statutory obligations. Upon approval of a state plan, the federal plan will no longer apply to MSW landfills in that state.
