| Title: Revised Response to Clean Air Act Section 126(b) Petition From New York | |
|
Abstract:
This action will respond to a 2018 Clean Air Act section 126(b) petition from New York. The petition requests a finding from the EPA that emissions from numerous sources in nine states (Illinois, Indiana, Kentucky, Maryland, Michigan, Ohio, Pennsylvania, Virginia and West Virginia) significantly contribute to nonattainment and interfere with maintenance of the 2008 and 2015 ozone National Ambient Air Quality Standards in New York. The EPA previously denied the petition in 2019. Petitioners challenged the denial and on July 14, 2020, the D.C. Circuit vacated and remanded the EPA's denial (New York v. Environmental Protection Agency No. 19-1231 (D.C. Cir. 2020)). This action addresses the courts vacatur and remand and provides a revised response to the petition. |
