Title: ●Federal ‘‘Good Neighbor Plan’’ for the 2015 Ozone National Ambient Air Quality Standards; Response to Judicial Stay 
Abstract: EPA finalized the disapproval of 21 states’ good neighbor SIP submissions in a rule published on February 13, 2023 (88 FR 9336). EPA subsequently signed final action of the Good Neighbor Plan Rule on March 15, 2023, establishing EGU and non-EGU FIP obligations for sources in 23 states, including the states included in the February SIP disapproval action. Petitioners filed motions to stay EPA’s disapproval action with respect to certain states. The United States Court of Appeals Circuit Courts granted motions to stay EPA’s disapproval of SIP submissions in some of those states. EPA responded to the courts’ decisions in two interim final rules (88 FR 49295; 88 FR 67102) staying the Plan’s implementation in those states pending further EPA rulemaking. Then, on June 27, 2024, the United States Supreme Court issued an opinion granting applications brought by four sets of parties for a stay of the Good Neighbor Plan pending completion of judicial review. In this action, the EPA will stay the Good Neighbor Plan in accordance with the Court’s decision and reinstate the requirements under two prior rules, the CSAPR Update and Revised CSAPR Update, to ensure that states’ obligations to address interstate ozone pollution for the 2008 ozone NAAQS continue to be met.
