| Title: Air Curtain Incinerators Used for Clean Lumber, Wood Waste, Yard Waste and Temporary Use Incineration During Disaster/Emergency Debris Cleanup | |

Abstract:
The purpose of this action is to publish an interim final rule under Clean Air Act (CAA) section 129 for temporary-use incinerators and air curtain incinerators (ACI) used in disaster recovery and emergencies. This action will also consolidate provisions for ACI that only burn wood wastes, yard wastes and clean lumber into a single location and resolve inconsistencies in certain section 129 rules. Currently, emissions standards for ACI that only burn wood wastes, yard wastes, and clean lumber have been promulgated across four different source categories: Large Municipal Waste Combustors, Small Municipal Waste Combustors, Commercial and Industrial Solid Waste Incineration Units, and Other Solid Waste Incineration Units. This division has resulted in inconsistencies in the rules and created uncertainty within industries about which rules apply. This rule would resolve inconsistencies and consolidate all provisions applicable to these ACI in one new rule subpart. Additionally, this rule would exempt certain incinerators and ACIs from complying with Section 129 emission standards and associated requirements when they are used temporarily to incinerate debris in areas declared a State of Emergency or has a declaration that an emergency or a major disaster exists in the area. |
