View Rule

This rule will correct certain paragraph references in the Environmental Protection Agency (EPA) Prevention of Significant Deterioration (PSD) regulations to conform with the revised paragraph designations required by the Office of the Federal Register and completed under RIN 2060-AW26. Specifically, this rule will correct citations in 40 CFR 51.166 and 40 CFR 52.21 to fourth level subparagraphs that were revised under RIN 2060-AV51 from (a), et seq., to (A), et seq. to be consistent. This rule is exempt from notice-and-comment rulemaking under the Administrative Procedure Act because it qualifies for the “good cause” exception to those requirements. This rule involves minor technical corrections that make notice-and-comment procedures unnecessary.
