Abstract:
This final action is clarifying the definition of “applicable requirement” within EPA’s Title V operating permit program regulations to address the extent to which other Clean Air Act (CAA) requirements—including emission control requirements established under the New Source Review preconstruction permitting program and requirements under the CAA section 112(r)(1) “General Duty Clause”—may be reviewed, modified, and/or implemented through the Title V permitting and petition process. The proposal for this action was published 1/9/24 (89 FR 1150) under RIN 2060-AV61. |
