| Title: ●Large Municipal Waste Combustors Title V Permitting Provisions | |

Abstract:
On January 23, 2024, in accordance with requirements under section 129 of the Clean Air Act (CAA), the U.S. Environmental Protection Agency (EPA) performed a 5-year review of the emissions standards and other requirements for the Large Municipal Waste Combustor (LMWC) standards. As part of that action, EPA proposed to eliminate the title V permitting requirement for air curtain incinerators (ACI) that burn only wood waste, clean lumber, and yard waste and are not located at a major source or subject to title V for other reasons. EPA received both supportive and adverse comment letters from citizens, states, advocacy groups, NGOs, and industry stakeholders on the proposed title V provisions. In response to supportive comments received on the January 2024 proposal, this action is finalizing, as proposed, to remove the title V permitting requirements for ACI that only burn wood waste, clean lumber, yard waste, or a mixture of those, and are not located at title V major sources or subject to title V for other reasons. The EPA is finalizing this proposed action now to simplify the compliance obligations for owners and operators of these types of units. The proposal for this action was published 1/23/24 (89 FR 4243) under RIN 2060-AO18. |
