Abstract:
This rulemaking would amend the FHWA Emergency Relief (ER) program regulations to reflect changes in 23 U.S.C. 125 and 23 U.S.C. 120. The proposed rule also may consider changes to enhance and simplify the ER program's use of funding to increase system resilience. In addition, the proposed rule would include procedural changes to improve ER program delivery effectiveness and efficiency and would reexamine the regulatory requirements that are not explicitly required by statute. This rulemaking would amend 23 CFR part 667 to provide greater flexibility to States in the identification and evaluation of facilities repeatedly damaged by extreme events and consider the effectiveness of part 667 by assessing the degree to which evaluations are benefiting investment decisions. |
