This rulemaking would amend the National Performance Management Measures regulations at 23 CFR part 490 with several updates necessary since the publication of these regulations. Anticipated updates include: aligning provisions in accordance with the recently passed Infrastructure Investment and Jobs Act, addressing compliance determinations and penalty assessment for the Pavement Condition measures, assessing the impact of national emergencies on performance achievement, clarifying data collection standards and requirements, updating the HPMS Field Manual incorporated by reference, and making other technical corrections. This rulemaking would also resolve data collection and reporting inconsistency (data format, data field labels and numbers, additional data items, etc.) in the current regulation pertaining to the National Performance Management Measures for assessing Bridge Condition (referred to as the Bridge Condition Measures”) in 23 CFR part 490 subparts A and D with the updates to the National Bridge Inspection Standards (NBIS).  These updates were previously included in the Agenda under RIN 2125-AF95.
