| Title: ●Hours of Service Exception for Railroad Signal Employees | |
| Abstract: Section 108 of the Railroad Safety Improvement Act of 2008 (RSIA), Public Law 110-432, signed 10/16/08, effective July 16, 2009, states that railroad signal employees operating motor vehicles shall not be subject to hours of service (HOS) rules promulgated by any other Federal authority, including the Federal Motor Carrier Safety Administration (FMCSA). The RSIA will require the FMCSA to amend its HOS regulations to state that FMCSA HOS regulations do not apply to railroad signal employees. The rule will provide clarity to the motor carrier industry and eliminate improper citations to signal employees because enforcement officers may not be aware of the statutory exception. | |
