Title: Uniform Criteria for State Observational Surveys of Seat Belt Use  
Abstract: Section 2002 of the Safe, Accountable, Flexible, Efficient, Transportation Equity Act; a Legacy for Users (SAFETEA-LU), Public Law 109–49, provides that the Secretary of Transportation may not approve a State Highway Safety Program that does not provide safety assurances that the State has conducted an annual state wide seat belt survey in accordance with criteria established by the Secretary. This rulemaking would update the existing criteria, which are found at 23 CFR part 1340, to develop a more uniform criteria.
