Title: ●Response to Petitions for Reconsideration of Part 563 Event Data Recorders Final Rule (Second Reconsideration)
Abstract: This rulemaking would respond to petitions for reconsideration of Part 563 Event Data Recorders (EDRs). On January 14, 2008, NHTSA published a final rule amending the requirements for EDRs in Part 563. The January 2008 notice responded to petitions for reconsideration of the original August 2006 final rule that established the EDR standardization requirements for those voluntarily installed in light passenger vehicles. In response to the January 14, 2008 final rule, the agency received three petitions for reconsideration from the Alliance of Automobile Manufacturers, the Association of International Automobile Manufacturers, Inc., and Mr. Thomas Kowalick, a private citizen. After careful consideration of the petition issues, the agency is granting some aspects of the petitions, and denying others. The main petition issues involve: removing the optional acceleration data element, making technical changes to address data clipping, clarifying the application of sensor tolerances, clarifying the event storage definition to alleviate uncertainties in multiple event crashes, making minor technical and editorial corrections, and addressing a request for a mechanical lockout device.
