Abstract:
On October 8, 2008, NHTSA published a final rule (73 FR 58887) amending the definition of the term, "designated seating position," as used in the Federal motor vehicle safety standards, to more clearly indicate which areas within the interior of a vehicle meet that definition. The final rule also established a calculation procedure for determining the number of designated seating positions at a seat location based upon seating surface width for passenger cars, buses, and light trucks and multipurpose passenger vehicles with a gross vehicle weight rating less than 4,536 kilograms. On December 23, 2009 (74 FR 68185), a partial final rule responding to petitions for reconsideration was published that allowed 1 additional year of lead time so that vehicle manufacturers would need to start complying with the final rule on September 1, 2011. On November 15, 2013 (78 FR 68748), a final rule addressing the remaining petitions for reconsideration and requests for interpretation of the October 2008 final rule, was published. However, a typographical error was made in the 2013 final rule in the expression of a formula contained in the regulatory text used to determine the number of designated seating positions for certain vehicles. The agency received a petition for reconsideration to correct this error. This rulemaking would make the requested correction. |
