Title: Hazardous Materials: Requirements for Storage of Explosives During Transportation 
Abstract: Currently, the Hazardous Materials Regulations (HMR) require all hazardous materials shipments stored during transportation to conform to the same requirements that apply when the shipments are actually moving. The Federal Motor Carrier Safety Administration (FMCSA) requires shipments of Division 1.1, 1.2, and 1.3 explosives to be attended at all times or allows for unattended storage in a safe haven. There are no specific requirements or guidance as to the key safety measures that must be in place for an area to be considered a safe haven. Through this rulemaking, PHMSA, in coordination with FMCSA, is designating the National Fire Protection Association (NFPA) standard 498 as the Federally approved standard for the construction and maintenance of safe havens used for unattended storage of Division 1.1, 1.2, and 1.3 explosives. This change will fill a safety gap in the safe haven designation process and provide state and local governments and the regulated community with Federal guidance regarding the key safety measures that need to be in place at safe havens.
