| Title: Hazardous Materials: Incorporation of Certain Cargo Tank Special Permits Into the HMR | |
| Abstract: This rulemaking would amend the HMR by incorporating alternatives that PHMSA has permitted under widely used and longstanding special permits that are granted to multiple parties and have established safety records. The provisions of the special permits would be incorporated as currently written, with no revisions or expansion of scope. The special permits addressed include authorization to transport liquefied petroleum gas (LPG) in non-DOT specification cargo tank motor vehicles used exclusively for agricultural purposes and authorization to transport certain hazardous materials used for roadway striping in non-DOT specification cargo tanks. Special permits allow a company or individual to package or ship a hazardous material in a manner that varies from the HMR provided an equivalent level of safety is maintained. Incorporation of the six special permits addressed in this rulemaking into regulations of general applicability would provide shippers and carriers with additional flexibility to comply with established safety requirements, thereby reducing transportation costs for industry and administrative costs for the agency. The provisions would reduce the paperwork caused by continued renewals of these special permits and eliminate the need for over 10,000 current grantees to reapply for the renewal of six special permits every four years. | |
