Title: ●Delegations of authority by the Board to specific offices of the Board 
Abstract:

The Board’s regulations at 49 CFR 1150 implement the Board’s statutes for entry licensing, including 49 U.S.C. 10502 (Authority to exempt rail carrier transportation), 10901 (Authorizing construction and operation of railroad lines), and 10902 (Short line purchases by Class II and Class III rail carriers). Pursuant to 49 CFR 1011.7(a), the Board has delegated the authority to make certain decisions under part 1150 to the Directors of certain of the Board’s internal Offices in the first instance, rather than requiring a decision by a majority of the Board members. Chairman Fuchs intends to conduct a comprehensive, deregulatory review of these regulations to identify ways to delegate additional licensing decisions and take other actions that reduce unnecessary barriers and burdens to market entry.
