Abstract:
This Direct Final Rule would revise HUD’s noise abatement and control regulations at 24 CFR part 51, subpart A, General Provisions and subpart B, Noise Abatement and Control to provide flexibility for administration across program offices, and to remove unnecessary provisions. The rule would establish that authority to issue approvals for projects and EIS waivers in unacceptable noise zones may extend to the Assistant Secretary level or equivalent or their designee for the relevant HUD program office, based on project funding, rather than only the Assistant Secretary for Community Planning and Development. The rule would also make needed updates to remove unnecessary provisions in 24 CFR 51.102, 24 CFR 51.106, and 24 CFR 51.3. |
