Title: NASA FAR Supplement, Cross Waiver of Liability
Abstract: This rule revises the NASA FAR Supplement to change the coverage of the existing cross waiver clauses to reflect the revised NASA authority established by the final rule published at 73 Fed. Reg. 10143-50, dated 26 February 2008, consistent with the change in NASA programs Cross-waivers of liability are situations in which all parties participating in a venture agree to exempt other partners from liability for damage. NASA has included cross waiver of liability clauses in all launch services agreements with U.S. and foreign parties since NASA's original cross-waiver regulations were published in 1991. However, those clauses were focused on launch services for Space Shuttle whereas the restructured clauses in this rule extend the existing principles into contracts for International Space Station (ISS) activities that involve a launch and Science or Space Exploration activities unrelated to the ISS that involve a launch.
