| Title: NASA Traffic Enforcement | |
| Abstract: It is the policy of the National Aeronautics and Space Administration (NASA) that an effective, standardized, and comprehensive traffic safety program be established and maintained at all NASA installations. NASA does not have a regulation criminalizing speeding and other noncriminal traffic infractions. As a result, our only option is the issuance of administrative traffic citations that are only written warnings which have very limited impact on traffic safety at our centers. NASA Security Forces participate in the Federal Magistrates System and are able to write District Court violation notices (DCVNs) for offenses up to and including DUI. As a nonfederalized infraction, speeding cannot be assimilated using title 18, section 13, Assimilative Crimes Act. Therefore, our officers are unable to issue DCVNs for speeding. To resolve this problem, NASA is proposing a new rule to be incorporated into CFR 1204 subpart 10, NASA Traffic Safety. The new rule will encompass state vehicular and pedestrian traffic laws and apply to all persons who operate or control a motor vehicle or otherwise use the streets of a NASA installation over which the United States exercises exclusive or concurrent legislative jurisdiction. | |
