| Title: Board of Veterans' Appeals: Rules of Practice--Revision of Decisions on Grounds of Clear and Unmistakable Error | |
| Abstract: The Board of Veterans' Appeals is proposing to amend its Rules of Practice to implement the provisions of Public Law 105-111, which permits challenges to Board decisions on the grounds of "clear and unmistakable error" (CUE). The amendments would (1) provide specific application procedures; (2) establish decision standards based on established caselaw; and (3) eliminate the Board's Chairman's discretionary review under "reconsideration" as duplicative, particularly given the Board's limited resources. These changes are necessary to implement the new statutory requirements. | |
