The Department of Veterans Affairs (VA or Department) is proposing to amend its Categorical Exclusion list (38 CFR 26.6 (b)) within its existing National Environmental Policy Act (NEPA) implementing regulations. Specifically, VA proposes to modify existing and identify new categories of actions that do not individually or cumulatively have a significant effect on the human environment. VA’s NEPA implementing regulations were developed in 1986 and amended in 1989. Since that time, VA policies and activities have changed, and this action would update and expand the CATEX list. The updates to the CATEX list would reflect the current range of activities within VA and better align the NEPA review process addressing current-day operational activities. The update to the CATEX list will enable VA to execute its mission to construct, maintain, operate, and repair an extensive network of facilities and infrastructure for Veterans.
