| Title: Updating VA Adjudication Regulations for Disability or Death Benefit Claims Based on Toxic Exposure | |

Abstract:
In a document published in the Federal Register on October 1, 2024, the Department of Veterans Affairs (VA) proposed to amend its regulations to implement provisions of the Sergeant First Class Heath Robinson Honoring our Promise to Address Comprehensive Toxics Act of 2022 (PACT Act). After considering public comments, input from the Veterans Health Administration Health Outcomes Military Exposures (VHA HOME) Team, and further research, VA has decided to finalize its proposal with some modifications to expand VA benefits eligibility, such as including additional service locations (e.g., Karshi-Khanabad (K2) Airbase) for certain presumptive conditions. VA's final rule also includes slight modifications to promote consistency to PACT Act processing and ensure claims processors consider all pertinent factors in adjudicating PACT Act claims. |
