Title: Third Party Accreditation for Testing of Children's Sleepwear 
Abstract: Section 102 of the Consumer Product Safety Improvement Act of 2008 (CPSIA), Public Law 110-314, 122 Stat. 3016 (August 14, 2008), mandates that third party testing be conducted for certain children's products. Section 3(a)(2) of the Consumer Product Safety Act (CPSA) defines a children's product as "a consumer product designed or intended primarliy for children 12 years of age or younger." Section 102 of the CPSIA also directs the Commission to publish a notice of requirements for accreditation of third party conformity assessment bodies (laboratories) to assess conformity with such children's product safety rules. The Commission initiated a process to establish the requirements that third party conformity assessment bodies must meet for Commission acceptance of accreditation for testing pursuant to 16 CFR part 1615, Standard for the Flammability of Children's Sleepwear: Sizes 0 Through 6X (FF 3-71) and part 1616, Standard for the Flammability of Children's Sleepwear: Sizes 7 Through 14 (FF 5-74). These regulations set minimum standards for flammability of children's sleepwear under the Flammable Fabrics Act. On November 10, 2010, the Commission voted to approve publication of the notice of requirements. The notice of requirements was published in the Federal Register on November 19, 2010.
