Title: Third Party Accreditation for Testing of Children's Wearing Apparel 
Abstract: Section 102 of the Consumer Product Safety Improvement Act of 2008 (CPSIA), Public Law 110-314, 122 Stat. 3016 (August 14, 2008), mandates that third party testing be conducted for certain children's products. Section 3(a)(2) of the Consumer Product Safety Act defines a children's product as a "consumer product designed or intended primarily for children 12 years of age or younger." Section 102 of the CPSIA also directs the Commission to publish a notice of requirements for accreditation of third party conformity assessment bodies (laboratories) to assess conformity with such children's product safety rules. Although clothing textiles are often used in nonchildren's wearing apparel, some clothing textiles are designed or intended primarily for children 12 years of age or younger. The Commission initiated a rulemaking to establish the requirements that third party conformity assessment bodies must meet for Commission acceptance of accreditation to test the flammability of clothing textiles and textile fabrics intended for children's wearing apparel pursuant to 16 CFR part 1610, Standard for the Flammability of Clothing Textiles. The standard provides a test to determine whether such clothing and fabrics exhibit "rapid and intense burning" and therefore are highly flammable. On August 9, 2010, the Commission voted to approve publication of the notice of requirements. The notice of requirements was published in the Federal Register on August 18, 2010.
