| Title: ●Public Accommodations Facility Interpretation | |
| Abstract: The Virginia Graeme Baker Pool and Spa Safety Act, Public Law 110-140, (VGB Act), imposes certain requirements on public pools and spas. Public pools and spas are defined to include, in relevant part, pools or spas open exclusively to patrons of a hotel or other "public accommodations facility." Section 1404(c)(2)(B)(iii) of the VGB Act. The term "public accommodations facility" is not defined in the VGB Act. On August 4, 2010, the Commission voted (5-0) to withdraw a proposed interpretive rule published on March 15, 2010 interpreting the term public accommodations facility. The Commission also voted to redraft for publication in the Federal Register a new proposed interpretive rule. This new proposed interpretive rule would interpret public accommodations facility to mean "an inn, hotel, motel, or other place of lodging, including, but not limited to, rental units rented on a weekly or bi-weekly basis" and include a sixty day comment period. | |
