| Title: Standard for Hook-On Chairs | |

Abstract:
Section 104 of the Consumer Product Safety Improvement Act of 2008 (CPSIA) requires the Commission to issue consumer product safety standards for durable infant and toddler products. The Commission is directed to assess the effectiveness of applicable voluntary standards and, in accordance with the Administrative Procedure Act, promulgate consumer product safety standards that are substantially the same as the voluntary standard or more stringent than the voluntary standard if the Commission determines that more stringent standards would further reduce the risk of injury associated with the product. The CPSIA requires that not later than August 14, 2009, the Commission begin rulemaking for at least two categories of durable infant or toddler products and promulgate two such standards every six months thereafter. The Commission will propose a consumer product safety standard for hook-on chairs as part of this series of standards for durable infant and toddler products. Staff prepared an NPRM briefing package for Commission consideration. On June 26, 2015, the Commission voted unanimously to approve publication in the Federal Register of the notice of proposed rulemaking regarding a safety standard for portable hook-on chairs. Staff sent the briefing package to the Commission on June 17, 2015. The proposed rule would adopt, without modification, the current ASTM standard on portable hook-on chairs (ASTM F1235-15) as the mandatory hook-on chair standard. The NPRM was published in the Federal Register on July 2, 2015. Staff sent a Final Rule briefing package to the Commission on March 2, 2016. The Commission voted unanimously (5-0) on March 8, 2016 to approve publication in the Federal Register, as drafted, of the Final Rule establishing a mandatory safety standard for hook-on chairs, pursuant to the Danny Keysar Child Product Safety Notification Act, section 104 of the Consumer Product Safety Improvement Act of 2008. The Final Rule incorporates by reference the applicable voluntary standard, ASTM F1235-15, Standard Consumer Safety Specifications for Portable Hook-On Chairs, without any modifications. In addition, the Final Rule amends 16 CFR part 1112 to include the mandatory safety standard for hook-on chairs in the list of Commission-issued notices of requirements. |
