Staff submitted to the Commission a draft advance notice of proposed rulemaking (ANPR) to initiate a rulemaking proceeding under the Consumer Product Safety Act (CPSA) and the Federal Hazardous Substances Act (FHSA). On March 6, 2024, the Commission voted to publish the ANPR in the Federal Register. The ANPR discusses the risk of injury associated with mechanical hazards of e-bikes as well as existing regulations, voluntary standards, and potential regulatory options under the CPSA and FHSA. The ANPR invited comments in response to questions about e-bike usage, incidents, market information, potential requirements to address any mechanical hazards, and their potential impacts. The ANPR was published on March 15, 2024, and the comment period closed on May 14, 2024. Staff have reviewed comments and is preparing a notice of proposed rulemaking (NPR) briefing package for Commission consideration.
