| Title: ●Rescission of Uniform Guidelines on Employee Selection Procedures | |

Abstract:
The EEOC is rescinding the interpretive rulemaking portions of the Uniform Guidelines on Employee Selection Procedures (UGESP), codified at 29 CFR part 1607, and its associated appendix, from the Code of Federal Regulations. UGESP predates the 1991 amendment of the Civil Rights Act of 1964. UGESP applies to tests and other selection procedures used to make employment decisions. When a test or other selection procedure is determined to have an adverse impact, UGESP requires the employer to validate the test or procedure and to retain the validation documentation. Using this information, the employer evaluates the selection procedures for adverse impact. This action would not impact other agencies' interpretation and application of UGESP. |
