| Title: Telemarketing Sales Rule | |

Abstract:
Commission staff is considering proposed "Anti-Fraud" amendments to the Telemarketing Sales Rule (TSR) concerning, among other things, the misuse of novel payment methods, such as remotely created checks, remotely created payment orders, cash-to-cash money transfers, and cash reload mechanisms in inbound or outbound telemarketing transactions, by telemarketers and sellers. On May 21, 2013, the Commission issued a notice of proposed rulemaking (NPRM), which was published in the Federal Register on July 9, 2013. 78 FR 41200. After a short extension, the comment period closed on August 8, 2013. Commission staff reviewed the comments submitted in response to the NPRM, and forwarded a recommendation to the Commission. In the middle of November 2015, the Commission announced the pending publication of a final rule for Anti-Fraud” amendments . Publication of the Federal Register notice is expected by December 2015. Commission action by the end of 2016. On August 11, 2014, the Commission initiated periodic review of this rule and solicited public comments. 79 FR 46732. The comment period as extended closed on November 13, 2014. 79 FR 61267. Staff anticipates making a recommendation to the Commission by 2016. |
