NARA is creating a new system of records for insider threat information. Because the system contains investigatory material complied for law enforcement purposes, the system is eligible for exemption under 5 U.S.C. 55a(k)(2) and (5). This rulemaking revises 36 CFR 1202.92, "What systems are exempt from release under the Law Enforcement Exemption of the Privacy Act?," and 36 CFR 1202.94, "What NARA systems of records are exempt from release under the Investigatory Information Material exemption of the Privacy Act?," to add the insider threat system of records.
