Abstract:
The Institute of Museum and Library Services (IMLS) is amending its regulations implementing Title VI of the Civil Rights Act of 1964 to eliminate disparate-impact liability. These amendments align IMLS’s regulations with Title VI, avoid constitutional concerns, reduce compliance costs, serve the public interest, and implement changes directed in Executive Order 14281. This is a deregulatory action in furtherance of Executive Order 14219, which requires that Federal regulations reflect the best reading of underlying statutory authority. |
