Title: Rules of Practice in Air Safety Proceedings 
Abstract:

The National Transportation Safety Board (NTSB) proposed amending its rules of practice for emergency appeals, 49 CFR 821.55, to require the Federal Aviation Administration (FAA) to provide releasable portions of its enforcement investigative report (EIR) to each respondent in emergency cases. The NTSB's NPRM, issued on September 19, 2013, stated the Pilot's Bill of Rights, signed into law in August 2012, required the FAA to release the EIR in non-emergency cases. The NPRM proposed extending this requirement to emergency cases. The NTSB has since withdrawn the rulemaking because the agency determined that it does not have the authority to control the FAA's handling of emergency cases before a respondent appeals to the Board.
