Title: Production of Records in Legal Proceedings 
Abstract:

49 CFR part 837 contains procedures for requesting from the National Transportation Safety Board (NTSB) records for use in legal proceedings. The NTSB plans to revise 49 CFR part 837, and move part 837 to new part 835, subpart B. Separate from part 801, part 837 describes how litigants may obtain records in conjunction with NTSB employee testimony, under 49 CFR part 835. The NTSB intends the revisions to be nonsubstantive. The regulations will be reorganized and rephrased for clarity. Because the NTSB does not expect adverse comments on the nonsubstantive revisions, the NTSB is revising part 837 through a Direct Final Rule (DFR). The DFR for part 837 follows a notice the NTSB published in the Federal Register in June 2012, which indicated the NTSB would review all NTSB regulations and amend them to ensure they are up-to-date, in accordance with Executive Orders 13563 and 13579. The DFR for part 837 will also reorganize part 835 as new part 835, subpart A. This RIN (AA05) is being merged with the RIN for part 835 (AA04). See 3147-AA04 for all future activity related to parts 835 and 837.
