Title: Fitness-For-Duty Programs [NRC-2009-0090] 
Abstract:

This rulemaking would amend the Commission's regulations to extend the 10 CFR part 26, subpart I work-hour controls to personnel who perform independent quality control/verification (QC/QV) checks under a part 50 licensee's NRC-approved quality assurance program.  Additionally, this rulemaking will consider three petitions for rulemaking (PRMs) that request changes to the subpart I provisions:  PRM-26-3, PRM-26-5, and PRM-26-6.  Finally, this rulemaking will consider any unintended consequences associated with the 2008, subpart I amendment, including any issues stemming from the 2011, rulemaking on minimum days off requirements.  The Commission directed this rulemaking in SRM-SECY-06-0244.  On July 14, 2015, the Commission approved the staff’s request to discontinue this rulemaking (SRM-SECY-15-0074).  This approval was based on the staff’s determination that extending work-hour controls to QC/QV personnel would not result in a substantial increase in the overall protection of the public health and safety or the common defense and security.  A Federal Register notice will be published to inform the public that this rulemaking is discontinued and that the three PRMs will be addressed in a separate action.
