| Title: Fitness-for-Duty (HHS Requirements) (NRC-2009-0225) | |
| Abstract: The direct final would amend the Commission's regulations to correct technical errors associated with drug testing requirements and enhance the alignment of 10 CFR part 26 drug testing requirements with those issued by the Department of Health and Human Services (HHS). This rule would enhance consistency with advances in similar rules and guidelines, including, but not limited to HHS Mandatory Guidelines for Federal Workplace Drug Testing Programs. This rulemaking is significant because these inaccuracies, if left uncorrected, would result in an unnecessary regulatory burden on licensees and other entities that operate licensee testing facilities. The urgency of this rulemaking is low, an Enforcement Guidance Memorandum regarding the dispositioning of violations has been issued and few industry concerns have been identified. The rulemaking has no impact on the public and minimal impact on the industry since the inaccurate provisions are effectively mitigated by the industry actions. | |
