Abstract:
Executive Order 13891, Promoting the Rules of Law Through Improved Agency Guidance Documents, directed agencies to issue regulations that set forth procedures for issuing guidance documents. The executive order explained the importance of ensuring that Americans are subject only to obligations imposed through duly enacted statutes or through regulations lawfully promulgated under statutes, rather than guidance documents, and that Americans have fair notice of their obligations. Consistent with the executive order, the Bureau is considering regulations to ensure that it issues guidance documents through fair and responsible procedures. |
