Title: Employment in the Excepted Service 
Abstract: OPM is issuing proposed regulations to implement a change to pass over procedures for preference eligibles with a compensable service-connected disability of 30 percent or more contained in subpart 302.401(b) of title 5, Code of Federal Regulations. We are making this change in response to a U.S. Court of Appeals decision that affects pass overs of preference eligibles in the excepted service. This action will conform OPM’s regulations with the court’s decision.
