Title: ●Federal Employees Dental and Vision Program; Preemption Requirements 
Abstract:

The U.S. Office of Personnel Management (OPM) is issuing this proposed rule to clarify its requirement that Federal Employee Dental and Vision Insurance Program (FEDVIP) carrier contracts preempt State premium taxes and Marketplace exchange assessments.  This regulation will affirm that a FEDVIP carrier’s rights and responsibilities pertaining to reimbursement relate to the nature, provision and extent of coverage for benefits and benefit payments provided under title 5, United States Code Chapters 89A & 89B, and therefore are effective notwithstanding any state or local law or regulation relating to dental or vision insurance or plans.  This regulation clarifies that premium taxes and Marketplace exchange assessments are intended to be preempted under FEDVIP carrier contracts.
