The Presidio Trust will propose to rescind or revise regulations for implementing the procedural provisions of the National Environmental Policy Act of 1969 (NEPA). The purpose of the rulemaking is to remove references to the Council on Environmental Quality's regulations at 40 CFR 1500 et seq. and to address the requirements and deadlines established in the Fiscal Responsibility Act of 2023, Pub. L. No. 118-5 (FRA). Areas covered by these regulations include requirements for Environmental Assessments (EA) and Environmental Impact Statements (EIS) and the actions typically requiring EAs or EISs. These regulations also address public involvement in the Trust's environmental review process and the manner in which environmental issues will be considered by the Trust in its decision-making process.
