Abstract:

In accordance with Executive Order 14219, we propose to amend our regulations at 20 CFR 222.17 to remove obsolete language that would treat male spouses and survivors with a child in care less favorably than similarly situated female spouses and survivors. This language does not reflect current Board practice or policy, and would violate the Equal Protection Clause of the Fourteenth Amendment to the U.S. Constitution if enforced.
